This includes any information, text, links, graphics, photos, audio, video, or other materials uploaded or appearing on the Service (collectively referred to as "Content"). This agreement is entered into by and between Emaillistvalidation, a company incorporated under the laws of Slovakia, with its registered seat at Šípová 1288/47, 949 01 Nitra-Chrenová, Slovakia, (collectively referred to as the "Provider," "Service Provider," "we," or "us"), and the individual or entity accessing or using the Services offered on our Website (collectively referred to as "Website Visitor," "User," "Customer," or "you"). By accessing, browsing, registering, or using the Website, or by subscribing to newsletters or contacting us, you acknowledge your agreement to these Terms. We reserve the right to update, modify, or alter these Terms at any time without prior notice. Unless otherwise required by law, changes take effect immediately upon publication on our Website. By continuing to use the Website after updates, you agree to the revised Terms. Please periodically review these Terms for changes; the effective date will always be displayed at the top of this page.

1. Definitions

Affiliate: Any entity under the control of the Provider, where "control" means ownership or the right to control greater than 50%.

GDPR: Regulation (EU) 2016/679 of The European Parliament and of The Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation).

Personal Data: Any information relating to an identifiable individual who can be directly or indirectly identified by reference to an identifier. This includes data from Website Visitors and Users entrusted to us for processing.

Emaillistvalidation: The service provided by the Provider.

Website: mailver.net operated by the Provider.

Website Visitor: Any individual or entity visiting the Website and potentially communicating with us.

User: Website Visitors who subscribe to communications, register, or use free or paid services offered on the Website.

Customer: Users who access paid services on the Website.

Account: To use the Service, you must create an individual account accessed with your login credentials.

API: Application Programming Interface connecting the Provider’s services with other websites, servers, or applications.

2. Who Can Use Our Service

The Services are available to individuals and entities capable of forming legally binding contracts under applicable law. They are not available to minors. By using the Website, you confirm that you are of sufficient legal age to create binding obligations.

While using the Website, you must act lawfully and respect the rights of others. Do not upload, link, or engage in behavior that is fraudulent, obscene, defamatory, or in violation of any third-party rights, including intellectual property rights.

The Provider may display advertising on the Website or alongside Content as part of the Service.

You must provide accurate and up-to-date contact information and billing details. Misleading or false information is prohibited.

By using the Service, you confirm that you act as a data controller and comply with all applicable data protection laws, including GDPR and other privacy regulations in the EEA and its member states.

You must only use the Service to verify email addresses of recipients who have explicitly permitted you to include them in your email list or for whom you have another valid legal basis for processing personal data.

By using our Service, you confirm that you meet these requirements and will not use the Service in any way that violates applicable laws or regulations. This representation constitutes a legally binding promise.

3. Prohibited Practices

You may not use the Service in any way that violates local, state, national, or international laws, these Terms, our Privacy Policy, or the rights of any third party, whether intentionally or unintentionally.

You agree not to use any robot, spider, or other automated device or manual process to monitor or copy the Website, its contents, or any information therein without our prior express written consent. Additionally, you must not interfere or attempt to interfere with the proper functioning of the Website through any means.

You further agree not to introduce to the Website any viruses, worms, time bombs, or other harmful programming routines designed to damage, disrupt, intercept, or expropriate any system, data, or information. You are prohibited from providing content that could create liability for us.

4. Services: What We Provide

Our Website provides tools for verifying email addresses and accessing additional features and services.

Subject to these Terms, we grant you a limited, temporary, revocable, and non-exclusive license to access, browse, and use our Website.

Free Service:

When you visit the Website, we offer limited content about email verification, notifications about our Service, and the ability to create an account.

When signing up for the Service, you must provide accurate and complete information, including your first name/company name and email address. You are responsible for maintaining the accuracy of this information and the security of your account and assigned API key. Your password and API key must remain confidential, as you are fully accountable for all activities under your account or API key.

You are allowed only one account on our Website. If we suspect multiple accounts, we may suspend or terminate any or all of them.

By creating an account, you can try the Service by verifying up to 100 email addresses without being charged after confirming your email address.

You agree to the following:

The Service may only be used for lawful purposes.
You must comply with our Data Processing Agreement when verifying email lists.
Email verifications use credits, with 1 credit verifying 1 email address.
You may upload email lists in a file or use our API to integrate with your own systems.
Integration with third-party email marketing accounts may require your API key, enabling us to programmatically access the minimum necessary information to provide functionality.

Your account grants access to the Service as we establish and maintain it. We reserve the right to modify, suspend, or terminate the Services at any time without notice or liability.

Paid Services:

Paid Services allow you to purchase email verification credits. By signing up, you agree to the listed conditions, pricing, and payment terms, which are subject to updates. Payments are non-refundable except as specified under our Money Back Guarantee.

New services may be introduced with additional fees, and existing fees may be updated at our discretion. Paid Services require accurate billing details and are accessible only through your account.

5. Payment

We do not charge for Free Services. Paid Services, including email verification credits, are subject to upfront payments, and these credits do not expire as long as your account remains active. Payments are processed via third-party providers like Stripe, Adyen, or PayPal, which ensure secure transactions.

Promotions may be available occasionally, subject to specific terms and conditions. Paid Service payments are final and non-refundable, except under the Money Back Guarantee.

6. Money Back Guarantee

Our 100% Money Back Guarantee applies if you send an email campaign to the email addresses you verified with Emaillistvalidation within 7 days of verification, and your hard bounce rate exceeds 4%. In this case, we will refund your last payment. This guarantee applies under the following conditions:

Emails must be verified using Emaillistvalidation’s website
The Money Back Guarantee does not apply to verifications completed using Emaillistvalidation’s API or One by One methods, as no records of these verifications are retained.
Your hard bounce rate exceeds 4%. Hard bounces occur when a recipient's email address does not exist.
The Money Back Guarantee does not apply to soft bounces. Soft bounces are related to personal sending history, settings, server, IP reputation, and email content.
The guarantee applies only to email addresses marked as "OK" by Emaillistvalidation’s verification service.
You must send an email to each verified "OK" address within 7 days of verification.
The percentage of hard bounces will be calculated as:
- (hard bounces / OK emails) × 100
- OK emails: All emails marked as "OK" since your last payment.
- Hard bounces: Emails marked as "OK" but resulted in hard bounces since your last payment.
You must use a professional third-party email sender for your campaigns.
Only providers offering detailed reports of soft and hard bounces are accepted. If such reports are unavailable, the Money Back Guarantee does not apply.
You must grant Emaillistvalidation access to your email sender account to review results, export reports, and analyze bounces.

If your payment is refunded, we may permanently delete your account and all associated data.

7. Data Protection and Privacy

By accepting these Terms and using our Service, you authorize Emaillistvalidation to process personal data necessary for providing the Service under the conditions outlined in these Terms, the Provider’s Data Processing Agreement, and the Privacy Policy, which are integral to these Terms.

Emaillistvalidation complies with the General Data Protection Regulation (GDPR). Details on how we ensure GDPR compliance, use cookies on the Website, and manage and process information that can identify you or third parties are provided in our Data Processing Agreement, Privacy Policy, and Cookie Policy, accessible at mailver.net.

8. Content

Emaillistvalidation and its affiliates own all rights, titles, and interests in the Service and the Website, including all improvements, updates, and materials (e.g., software, images, text, graphics, logos, patents, trademarks, copyrights). Unless explicitly stated otherwise, these Terms do not grant you a license or right to use these materials, and you agree not to sell, license, modify, distribute, or create derivative works based on any content accessed through the Service.

You use the content and materials available via the Service at your own risk. We do not endorse or guarantee the accuracy, reliability, or completeness of any content available on the Service.

By using our Service, you may upload email lists and associated data. You are solely responsible for ensuring that the uploaded data:

Does not infringe on any third-party rights, including intellectual property rights.
Is free from unlawful, abusive, harmful, or otherwise objectionable content.
Does not include sensitive personal data.
Complies with these Terms, the Data Processing Agreement, and the Privacy Policy.

Emaillistvalidation reserves the right, but not the obligation, to monitor content submitted to the Service. We are not liable for any loss or destruction of content, including personal data, and you are responsible for maintaining appropriate backups.

You may submit feedback about our Service. Emaillistvalidation reserves the right to use such feedback freely in connection with its Services.

The Website may contain third-party advertisements or links. If you navigate to third-party websites, Emaillistvalidation is not responsible for their terms, privacy policies, or any content provided by such sites.

9. Termination and Cancellation

We retain your information as required to fulfill legal obligations and resolve disputes. Uploaded files and result files are permanently deleted 30 days after upload.

Emaillistvalidation reserves the right to suspend or terminate your access to the Service at its sole discretion, with or without notice, if you violate these Terms. In such cases, we are under no obligation to maintain or forward any data related to your account.

If your account remains inactive for more than 12 months, it may be deleted, and all associated data permanently erased. Suspension or termination of an account will result in the forfeiture of any unused email verification credits, and no refunds will be issued for previous payments.

10. Limitation of Liability

The Service is provided "as is" and "as available." Without limitation, Emaillistvalidation expressly disclaims all warranties, whether express, implied, or statutory, regarding the Website and the Service, including but not limited to any warranties of merchantability, fitness for a particular purpose, title, or security. Neither Emaillistvalidation, nor its affiliates, owners, employees, contractors, suppliers, or licensors, guarantee that:

The Service will meet your requirements.
The Service will be uninterrupted, timely, secure, or error-free.
Information provided through the Service will be accurate, reliable, or correct.
Defects or errors will be corrected.
The Service will be available at any specific time or location.
The Service is free from viruses or other harmful components.

If Emaillistvalidation is unable to verify an email address, it will return the result "unknown." Any email verification credits deducted for unknown results will automatically be returned to your account for future use. However, the number or percentage of unknown results does not qualify for a refund under any circumstances.

Emaillistvalidation's liability is limited, even if informed of potential damages or issues. You acknowledge that you use the Service and access its content at your discretion and risk.

Emaillistvalidation does not warrant that information on the Website, or advice provided by its team, is complete, accurate, non-misleading, or true.

You accept full responsibility for any losses resulting from your use of the Website, services, tools, downloads, or advice. You agree to use the Service at your own risk, acknowledging that Emaillistvalidation is not responsible for delays, downtime, errors, or inconsistent results.

11. Indemnity

You agree to indemnify and hold harmless Emaillistvalidation and its affiliates from any claims, losses, or damages arising from:

Your use of the Service.
Breach of these Terms.
Unauthorized actions, such as using data-scraping tools or imposing unreasonable loads on our systems.

12. General Rules

Any contractual or legal relationship between the parties will be conducted in English.

These Terms constitute the entire agreement between the parties regarding your access to, browsing, and use of the Website, superseding all prior agreements, arrangements, understandings, and representations concerning the Website.

If any provision of these Terms, in whole or in part, becomes invalid, void, or unenforceable for any reason, it shall be severed from these Terms to the extent necessary without affecting the validity or enforceability of the remaining provisions.

In the event of any dispute, claim, question, or disagreement arising from or relating to this Agreement, whether in contract, tort, or otherwise, the parties agree to make their best efforts to resolve the issue amicably.

If a dispute arises, the complaining party must provide written notice to the other party, clearly detailing the nature of the dispute. If notice is being sent to Emaillistvalidation, it must be emailed to [email protected] and mailed to: Šípová 1288/47, 949 01 Nitra-Chrenová, Slovakia.

If the parties are unable to resolve the dispute amicably, they agree to submit the matter to binding arbitration in accordance with Slovak law and the jurisdiction of Slovak courts.
